Note that CIArb Thames Valley Branch's AGM will be taking place at 18.30 and the Seminar will commence at 19.00.
Capital contracts often include a third person/party engaged as The Engineer (or Project Manager, Supervising Officer, or Architect) charged with certifying, issuing orders decisions and instructions, and having a range of other specified duties.
The speaker argues, perhaps controversially, that the role of The Engineer can also extend to helping the contracting parties to avoid disputes.
How have the Courts approached this third person/party role? Is there scope for the Engineer to actively steer the parties through the implementation of the Contract so as to avoid disputes which might otherwise be detrimental to both parties?
The speaker, Eur Ing David M Wilson is both a Chartered Engineer and Chartered Arbitrator. He holds a degree in mechanical engineering and is a European Engineer, a Fellow of the Institution of Mechanical Engineers and a Fellow of the Chartered Institute of Arbitrators. His experience of capital plant engineering projects extends over more than thirty five years and encompasses posts with contractor, consulting engineer and purchaser. He has more than fifteen years experience as arbitrator, adjudicator and expert determiner - time focussed closely on disputes in engineering contracts. David is a member of the joint IET/IMechE Model Forms Drafting Committee and is Deputy Chairman of the IChemE Dispute Resolution Committee. He has been a member of the CIArb Thames Valley Branch committee for many years and is a Past Chairman of the Branch.
