This is a meeting organised by the Thames Valley Branch of the Chartered Institute of Arbitrators at which ICE members will be most welcome.
Refreshments will be available from 18.00 until 18.30 when the presentation will commence.
Our speaker, Her Honour Frances Kirkham BA AKC FCIArb CBE, will consider wide-ranging issues regarding the use of expert evidence in the resolution of construction and engineering disputes, whether in informal negotiation, through mediation, or by adjudication, arbitration or litigation. These will include: At what stage and by whom should Experts be appointed? Should Experts make a case or undertake negotiations for a party? Should there be greater use of single, jointly instructed Experts? How effective are without prejudice meetings of Experts? Should the parties/lawyers be entitled to set the agenda for such meetings? Does the use of Experts contribute to achieving a fair result? Frances hopes that her remarks will facilitate a debate.
Frances Kirkham is a Chartered Arbitrator. She practised as a solicitor in private practice before being appointed the designated TCC judge in Birmingham; a post which she held for over 10 years. As a judge, Frances dealt with cases in the TCC, Mercantile, Chancery and Administrative Courts. She now acts as arbitrator, adjudicator and mediator. In addition she is a consultant to the International Commercial Court in Qatar to assist with creation of a specialist construction court.
Frances is tasked by the Society of Construction Law to collate members' views about the use of Expert Witnesses in dispute resolution in the construction industry and recommendations for change.
