The Corporate Manslaughter and Corporate Homicide Act and the Health and Safety (Offences) Act have together ushered in a new era of criminal liability for organisations, directors and employees, transforming the legal landscape applicable to fatal accidents. 

Recent experience shows that investigators and prosecutors are willing to deploy the full arsenal of applicable criminal offences against both organisations and individuals following a fatal accident.  Now, more than ever before, there are substantial risks associated with a fatal accident both for organisations and individuals.  These include criminal conviction, improsonment, director disqualification, severe reputation damage and very high fines.  This has all led to a change in the way in which a fatal accident is investigated and defended.

Richard Matthews QC sets out the Corporate Manslaughter and Corporate Homicide Act 2007, the Health and Safety (Offences) Act 2008, and outlines changes to the Coroner system.  Guy Bastable goes through the course of the investigation of a fatal accident, examining the investigators' powers and investigation risks.
