Disciplinary Notice – Mr David G MABEY

On 10 October 2012, the Disciplinary Board considered allegations of improper conduct against an Affiliate member, Mr David G Mabey, Membership Number 45353223 of Standerwick, Somerset.

On 10 February 2011 Mr Mabey was found guilty at the Crown Court, Southwark, of making funds available to Iraq contrary to Articles 3(A) and 11(4) of the Iraq United Nations Sanctions. It was alleged that matters of which Mr Mabey was convicted constituted improper conduct.

The Disciplinary Board found Mr Mabey guilty of Improper Conduct in relation to the allegations against him in that he had breached By-law 35 and By-law 37 and Rules 1 and 2 of the Institution’s Rules of Professional Conduct as applicable in 2000/2001, and By-law 35 and By-law 36 and Rule 6 of the Rules of Professional Conduct as applicable in 2011.

In summary, under these By-laws and Rules:

  • All members are required to order their conduct so as to uphold the dignity, standing and reputation of the Institution
  • Improper conduct meant any conduct, other than that laid down in By-law 37(1), which indicated unfitness to be a member or was otherwise unbefitting to a member as such
  • All members shall discharge their professional duties with integrity
  • A member shall uphold the dignity, respect and trustworthiness of the profession at all times
  • All members shall notify the Institution if convicted of a criminal offence.

Under the powers conferred on it by By-law 40, the Disciplinary Board ordered that Mr Mabey should be Suspended for six months and Severely Reprimanded.

The Disciplinary Board ordered that the fact and particulars of the Order against Mr Mabey, and the details of the improper conduct of which he had been found guilty, should be posted in the Institution and published.
