What is a dispute? In the context of the engineering and construction industries a dispute can be described as a matter of disagreement between the parties to a contract which requires the involvement and usually decision by a neutral.
The ICE Dispute Resolution Service is a service that appoints individuals to act as neutrals in dispute resolution proceedings.
There are a number of different forms of dispute resolution available. Those that involve a neutrally appointed person or persons and aim to settle the dispute outside of the courts are generally referred to as Alternative Dispute Resolution. The most common forms currently used in the UK are:
- Mediation
- Conciliation
- Expert Determination
- Adjudication
- Dispute Resolution Boards
- Arbitration
The type of dispute resolution used depends on the nature of the dispute, what is stipulated in the contract and the legal jurisdiction governing the contract.
Adjudication is currently the most popular form of Alternative Dispute Resolution used in the United Kingdom.
The ICE maintains register of individuals who are suitably qualified to conduct the various dispute resolution proceedings. The following Registers are maintained:
