Law and contract management (NEC3) course

ICE NW is delivering a training course in Manchester, which will prepare engineers (and other professionals) to sit the ICE Law and Contract exam.

Success in the exam is seen to be the first stage in becoming qualified as an adjudicator or arbitrator or as essential additional learning for those involved in project management.

The course involves about 120 hours of study time, in evening sessions, from September through to the following May, with the exam sat in June.

Course aims

  • To explain the English legal system and its application to civil engineering contracts
  • To explain the contents of the NEC contract documents, the contract procedures, the reasons why disputes arise and how they can be resolved
  • To prepare candidates for the ICE Law and Contract examinations (held each June)

Content

The course will follow the Institution's published syllabus.The way in which the law affects the Engineer as employer, employee, contractor, consultant and as a party to arbitration will be considered. The contract procedure part of the course will focus on the material required for Paper 2 of the Institution's examination (see below). Participants will be able to discuss actual problems they encounter in their professional work as far as these coincide with the course content.

The course has been approved by the Institution as being a suitable preparation for their examination.

The full course (including examination preparation) will require of the order of 120 hours of study time.
 

Who should attend?

This course is designed for those civil engineers and other professionals involved in civil engineering and construction who, in their employment, are becoming increasingly involved in contractual issues with authorities, consulting engineers and contractors.

Programme


Autumn Term
(10 weeks): Law (late Sept 2013 – Christmas 2013)

English Legal System : An introduction

Contract: Principles of contract law with particular reference to construction contracts.
 

Tort: Principles of civil liability relating to negligence, nuisance and the concept of strict liability, with the emphasis on case law relevant to the building and construction industry.
 

Employment law and insurance: Aspects of the law regulating employer and employee relations, trade unions, industrial injuries, welfare and safety at work.


Spring Term
(10 weeks): Contract Procedures (Jan 2014 – Mar 2014)
 

Civil Engineering Contract Procedure
Principles governing the preparation, formation and control of civil engineering contracts, with special emphasis on the NEC3 suite of contracts; tendering procedure; people involved with the contract and their responsibilities; payment procedures; disputes and their resolution.


Summer Term
(7 weeks): Contract Procedure continued, Examination and Revision (April 2014 to May 2014)
 

Initial two sessions to finalise Contract Procedure. 

Following four sessions devoted to revision and examination preparation. 

One session left spare.

Examinations follow in June (dates to be confirmed). 

Lecturers

Lectures will be from a range of industry practitioners, academia and the law lectures by Hill Dickinson.

ICE Examination

The Institution’s examination is held annually in June. It consists of two papers: Paper 1 (Law) and Paper 2 (Contract Procedures). Experienced engineers (15+ years) can substitute a Paper 3 for Paper 2. The Institution issues a certificate to candidates who pass the examination.

Lectures will be held in central Manchester.

The fee includes refreshments, copies of key NEC texts and course notes.
