Following the NEC pilot project commenced in 2009, and a number of other public works projects in subsequent years, NEC has become a major contract form in Hong Kong public works projects.

This webinar, presented by Mr Gordon Kwok and his colleague Mr Victor Fung, will first briefly discuss the current dispute resolution mechanisms in General Conditions of Contract adopted in public works projects in Hong Kong. Gordon will then provide an overview of some general aspects of the contractual arrangement and principles of NEC. This will then be followed by some selected experience sharing on the fundamental and technical aspects, and the latest trend of the adoption of NEC4 Design Build and Operate Contract of NEC in Hong Kong. Gordon will also present the approaching trend of the use of adjudication in resolving construction disputes with a particular focus on NEC4 ECC Option W1.

Gordon Kwok

Currently working as an Associate Director for JCP Consultancy International Ltd, Gordon is a legally trained negotiator, a chartered civil engineer, an accredited mediator, an accredited adjudicator, and an accredited arbitrator. He is a Fellow of Chartered Institute of Arbitrators (East Asia Branch) (FCIArb) in Hong Kong, a Fellow of Asian Institute of Alternative Dispute Resolution (FAIADR) in Malaysia, a Member of Institution of Civil Engineers (MICE) in the United Kingdom and a Member of Hong Kong Institute of Engineers (MHKIE) in Hong Kong. He served as an arbitrator for the Business Arbitration Services Panel of CIArb(EAB) in Hong Kong and the United Kingdom, and a Representative Neutral in the Construction Panel of Federation of Integrated Conflict Management in India. He is also a Co-founder of Hong Kong Institute of Construction Adjudicators (HKICAdj).

Having worked as a civil engineer and a contract advisor in Hong Kong, Gordon is experienced in providing construction contract advice on New Engineering Contracts and Hong Kong Government General Conditions of Contract in terms of claims and dispute resolution. Gordon is also experienced in managing and delivering a number of mega-infrastructure and community engineering projects, specialising in railways and waterworks.

Mr Victor Fung BEng (Hon)(UCL)

Independent claim consultant

The guest co-speaker, Victor, is currently a claims consultant. Since 2012, he has been assisting expert witnesses, lawyers and construction professionals with regard to claim matters using various methods of dispute resolution, including but not limited to reconciliation, mediation, dispute resolution advisory, adjudication, arbitration, and litigation. He also assisted in matters of insolvency.
