The pandemic, unfortunately, has not left the construction world untouched. Conflicts that previously lurked beneath the surface between construction parties are worsened by the pandemic and its economic aftermath. Additionally, clients, contractors, architects or engineers are confronted with additional challenges on site. It is therefore not surprising that some parties in the construction sector are working behind closed doors on drawing up various claims. All too often, this then results in starting legal proceedings.
The current judicial backlog across Europe and the legal uncertainty stemming from Covid-19-related case law requires a different approach. On top of that, for those with UK-ties, comes the reality of Brexit after 31 December 2020, when the EU/UK transition period comes to an end.
This event will provide insights as to why mediation now, more than ever, offers the most suitable alternative path that can be taken to achieve a quick and sustainable conflict resolution in construction matters. It will also turn its attention to Facilitated Contract (Re)Negotiation. It will do this looking both at times of Covid-19 and into the future within a European context that takes full cognisance of the Brexit reality.

Bart graduated with from the University of Leuven with a Master of Science in Civil Engineering in 1997 and Master of Statistics in 1999. Later he undertook various professional development trainings concerning negotiation and legal skills.
He has more than 20 years of experience as an independent expert, arbitrator and is a certified mediator in social, civil and commercial matters. He specialises in conflict resolution in construction matters. His main goal is to always to reach a sustainable resolution to any dispute.
Erik is an experienced Chartered Engineer and a registered International Professional Engineer who holds engineering degrees from the Universities of Antwerp, Liverpool and Plymouth. He has amassed over 20 years of international civil engineering and construction experience. He is a Fellow of the Institution of Civil Engineers and a Member of the Chartered Institute of Arbitrators. He is a CEDR accredited mediator as well as a fully accredited mediator in civil and commercial matters by the Federal Mediation Commission of the Belgian Ministry of Justice. He works as a freelance independent expert, arbitrator and mediator at Maverick Enterprise.
Anthony is Head of Mediation at Unity Legal Solutions. Anthony graduated from University of Cambridge with a First in Law in 1980 and is a hugely experienced barrister who practised at the Bar for 37 years, 19 of them as a QC. He appeared in many of the most complex and high-profile cases across his areas of expertise and was ranked in Chambers & Partners directory as a leading silk in 8 practice areas. Anthony is now doing both facilitative mediations and evaluative mediations (e.g., early neutral evaluation). He is accredited by CEDR and by the London School of Mediation who have accredited him as a mediator to international standards. He is a Member of the Civil Mediation Council, is a Civil Mediation Council registered mediator and on the CEDR Consumer Panel; and brings his extensive experience of litigation tactics and sound commercial sense to his mediation practice at Unity Legal Solutions. He was voted ‘Mediator of the Year’ in the Innovation & Excellence Awards 2019 and was voted ‘Commercial Mediator of the Year in England’ in the 2020 Global Law Experts Awards.
