Overview

How do you reconcile the climate ambitions with the demands of project delivery, and even tiered procurement?

In this CPD knowledge event, hosted jointly by ICE Yorkshire & Humber and the Chartered Institution of Civil Engineering Surveyors (CICES) Yorkshire, we will explore one way in which alignment of the whole project team can be created and reinforced proactively through commercial management.

Richard Patterson, procurement specialist at Mott MacDonald and NEC expert, was part of the NEC4 drafting team for clause x29, which is designed to help drive the achievement of net zero greenhouse gas emissions and other related climate change and biodiversity targets within projects. He will share his insights into the operation of the clause.

Nikolaus Moore, senior commercial manager at Skanska, will share his experience and learning having pioneered the adoption of the x29 clause to deliver specialist geotechnical works on a major highways project in the East of England.

This engaging session aims to explore how well-crafted contract clauses, specifically the NEC4 x29 secondary option, can be used as a powerful tool to align and incentivise parties towards achieving crucial climate outcomes. Attendees will have the opportunity to engage with the mechanisms in theory, and also with a live case study project, gaining practical insights that can applied towards our shared climate ambition.

Richard Patterson

Richard Patterson, NEC and procurement specialist at Mott MacDonald, is a chartered civil engineer and ICE Fellow who has been with the firm for 35-plus years.

He was a member of the drafting team for NEC4; the ICE’s working group on procurement, contracts and carbon/net zero; and the team that developed the recently released NEC secondary option, X29. This enables clients to include contractual targets incentivising contractors to provide lower-carbon solutions.

Keen for NEC to be used more widely, Patterson has trained people in its application in countries ranging from Australia and Ethiopia to Peru and the US.

He has contributed to two NEC books and served on the editorial advisory panel of the ICE’s Management, Procurement and Law journal. He is also a frequent contributor to the NEC’s website and newsletter.
