About this event

The industry has seen the introduction and rapid rise of so called “smash and grab” adjudications in the past few years but what does the term mean? Are such adjudications seen as an abuse of the system, or simply a party to a construction contract applying the rules to their specific mechanisms? Case law is constantly and swiftly evolving to address this issue and parties are advised to be acutely aware of their obligations and liabilities when it comes to the payment terms within their construction contract.

This lecture will address the key elements of the Construction Act with regard to payment arrangements, how these elements are transposed into the contracts in use in the industry and the common pitfalls and how the parties to a contract can protect themselves. It will reflect upon actual examples, some of which have been successful and some not, and will review some of the current case law on the matter. This talk will be beneficial to engineers, project managers, contract administrators and students alike.

Charles Wilsoncoft

Charles gained his BEng in Civil Engineering from the University of Liverpool in 2000 and started work as a site engineer with Morrison. Several years later, after working on a range of engineering projects spanning from the Isle of Man to Antarctica he gained his Chartered status and became a Member of the ICE.

He then moved to the project management team for British Waterways working on the Liverpool Canal Link. Thereafter he joined Knowles (now HKA) in 2009 as a consultant. There he gained his MSc in Construction Law and Arbitration and Membership of the CIArb and has since been involved in countless construction contract disputes, both in the UK and internationally. He regularly lectures on disputes, dispute avoidance and contract administration.
