Damage to underground ground services can cause serious and fatal injuries. There were over 60,000 strikes last year, with electricity cables causing the most severe consequences. But what could happen to you, as an individual, if you had failed to follow your personal responsibilities for health & safety?
ICE partnered with CECA, TfL and legal firm, Clyde & Co for a mock trial event to look at the potential ramifications when an employee is prosecuted under the Health and Safety at Work Act.
The event was held at City Hall in front of an audience of over 200 people who sat as’ jurors’. They were offered a snapshot of evidence from the prosecution and the defense as an employee stood trial to face the consequences of his actions and inactions. They were then required to determine guilt and sentencing. The event included important messages covering: communication, adherence to H&S documentation, training and designer responsibilities.
To reflect on the key messages from this event, ICE has produced a podcast which expands on the trial to include interviews with the prosecutor, defense lawyer, defendant and witnesses. Many of the audience were also asked to comment on the trial and their own personal understanding of where the liabilities are and of course the guilt of the defendant.
