ICE submission to the Post-legislative scrutiny: Flood and Water Management Act 2010 inquiry

The submission covers the sections of the Committee's inquiry relating to reservoirs and sustainable drainage systems (SuDS).

Reservoirs

There has been no significant progress in introducing regulatory requirements set out in the Flood and Water Management Act 2010 for reservoirs in England with a capacity between 10,000m3 and 25,000m3.

ICE believes that Government should:

  • Set out a clear timetable for the completion of a review to establish which small raised reservoirs in England should be brought under a new regulatory regime.
  • The review should be progressed in order to enable subsequent recommendations to be considered during this Parliament.

SuDs

There has been no significant progress in taking forward Schedule 3 of the Flood and Water Management Act 2010.

  • ICE believes that this is essential for the Government to implement Schedule 3 in order to drive uptake of SuDS in new developments.
