Overview

Designed for current and future decision makers in the profession who are either developing or interpreting construction contracts, this series delves into the nuances of Scots law and how these nuances could affect the everyday delivery of a construction contract. 

This is the second of a five‑part series delivered by Morton Fraser MacRoberts LLP (MFMac) in partnership with the ICE Glasgow and West of Scotland Branch.

This seminar will give a general introduction to NEC contracts and will focus, principally, on the differences between the NEC3 and NEC4 forms of contract, featuring insights from senior members of MFMac’s construction team.

Sarah Pengelly

Sarah has extensive experience in both jurisdictions across the energy, infrastructure, transport and real estate sectors.

She has advised on projects of all sizes and values, specialising in drafting construction and engineering contracts, including ancillary documents such as professional appointments, framework/call-off arrangements, construction contracts and contracts for supply and installation, operation and maintenance and long-term support, as well as providing advice on construction procurement arrangements.

Sarah has an LLM in Construction Law is accredited by the Law Society of Scotland as a specialist in construction law.

Maggie Kinnes

Maggie is a consultant in MFMac's Construction team.

Maggie has experience across a broad range of construction matters and specialises in non-contentious work, contract drafting, negotiation and advisory work, including NPD and PPP/PFI projects, project development work, and other major infrastructure and flagship projects.

She also provides strategic advice on dispute avoidance. Her clients include private and public sector contractors, consultants, developers and funders working in the construction industry, and she advises a number of public sector clients, including health boards, the Scottish Government and local authorities.
